(c), le Litige sera résolu avant la Cour suprême de l'Ontario siégeant dans la ville de Toronto, et vous et Inka Nature vous soumettez et reconnaissez irrévocablement par la présente la compétence originale et exclusive de ce tribunal à l'égard de tous ces différends, sauf qu'Inka Nature peut intenter une action en justice contre vous devant les tribunaux compétents de toute autre juridiction demandant une injonction (ou des recours juridiques urgents similaires) pour éviter un préjudice irréparable ou pour préserver le statu quo ou pour faire respecter les conditions générales. (c) Règlement informel des différends : avant d'entamer un arbitrage ou un litige concernant un différend : (i) vous aviserez du différend les représentants du service à la clientèle d'Inka Nature à service@inkanature.com ou au 1-888-343-3278 (États-Unis États-Unis) ou 1-800-304-1497 (clients canadiens). et Inka Nature au moins trente (30) jours pour enquêter et tenter de résoudre le différend ; et (ii) à la demande d'Inka Nature pendant la période de trente (30) jours, vous participerez à des discussions de bonne foi concernant le différend en vue de résoudre le différend de manière raisonnable. (d) Recours temporaire/injonctif : Nonobstant le fait qu'un différend est soumis à l'arbitrage en vertu de l'article 21(a) : (i) vous ou Inka Nature pouvez intenter une action en justice devant la Cour suprême de l'Ontario siégeant dans la ville de Toronto, en demandant une injonction (ou des recours juridiques urgents similaires) pour éviter un préjudice irréparable ou pour préserver le statu quo, et vous et Inka Nature vous soumettez et reconnaissez irrévocablement par la présente la compétence non exclusive de ce tribunal à l'égard de ces questions ; et (ii) Inka Nature peut engager des poursuites contre vous devant les tribunaux compétents de toute autre juridiction demandant une injonction (ou des recours juridiques urgents similaires) pour éviter un préjudice irréparable ou pour préserver le statu quo ou pour faire respecter les présentes conditions générales.
(e) AUCUN JURY OU RECOURS COLLECTIF : VOUS ET INKA NATURE. CHACUN RENONCE IRRÉVOCABLEMENT À TOUT DROIT À UN PROCÈS PAR JURY OU À COMMENCER OU PARTICIPER À UN ARBITRAGE OU À UN LITIGE COLLECTIF OU REPRÉSENTANT. TOUT ARBITRAGE OU LITIGE CONCERNANT LES DIFFÉRENDS SERONT INTRODUITS PAR VOUS OU INKA NATURE À TITRE INDIVIDUEL, ET NON EN TANT QUE DEMANDEUR OU MEMBRE DU GROUPE DANS UNE PROCÉDURE COLLECTIVE OU REPRÉSENTATIVE. LA RENONCIATION AU DROIT DE PARTICIPER À UNE PROCÉDURE COLLECTIVE OU REPRÉSENTATIVE EST INTERDITE PAR LA LOI DANS CERTAINES JURIDICTIONS.
